These Terms of Service (the "Terms") are a binding agreement between you and One Culture LLC, a Delaware limited liability company ("One Culture," "we," "us," or "our"). They govern your use of the Maurice the Music website at mauricethemusic.com, our iOS application ("Maurice" in the App Store), the Broken Buckle live-show experience, the kin fan-club, and all related features and content (collectively, the "Services").
By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 13 years old to use the Services. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may only use the Services with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. Certain features (including payments) may require you to be 18 or older.
You are responsible for activity that occurs under your account, the accuracy of information you provide, and the security of the phone number or email address you use to log in. Notify us promptly at contact@mauricethemusic.com if you suspect unauthorized use. You may delete your account at any time from /kin/account/delete.
Membership in the kin fan-club is free. Points and perks awarded inside the Services have no cash value, are non-transferable, cannot be redeemed for cash, and may be adjusted, expired, or revoked at our reasonable discretion. We may change or discontinue the kin program, its perks, or the way points are earned or redeemed, at any time.
"User Content" means anything you submit through the Services, including chat messages, song and drink requests, tip or sponsorship notes, sightings, photos, and support messages. You retain ownership of your User Content.
By submitting User Content, you grant One Culture a worldwide, royalty-free, sublicensable, non-exclusive license to host, store, reproduce, modify, display, distribute, and otherwise use your User Content for the purpose of operating, promoting, and improving the Services and Maurice's music and brand, on any media now known or hereafter developed. You represent that you have all rights necessary to grant this license and that your User Content does not infringe or violate anyone else's rights.

We may remove User Content and suspend or terminate access to the Services for violations, at our reasonable discretion.
Tips, drink purchases, song requests, donations, and sponsorships are one-time payments processed by Stripe on Stripe-hosted checkout pages or on mauricethemusic.com. When you purchase from the iOS app, the payment flow opens in an external in-app Safari browser operated by Apple. The transaction is a direct agreement between you and One Culture LLC and is subject to Stripe's terms in addition to these Terms.
All purchases are final and non-refundable unless (a) we cancel the associated show or perk, (b) Stripe charged you in duplicate due to a system error, or (c) refunds are required by law. If you believe you were charged in error, contact us within 14 days at contact@mauricethemusic.com.
Fulfillment of perks (drink runs, on-stage requests, sponsorship shout-outs) is at the reasonable discretion of the venue, the performer, and applicable law. We will make a good-faith effort to honor every request but cannot guarantee performance of content requested from the stage.
The Services, including all text, graphics, logos, images, audio, video, user interface designs, code, the name "Maurice the Music," the Broken Buckle mark, and related artwork, are owned by One Culture LLC or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual-property laws. Except as expressly permitted, you may not copy, modify, distribute, publicly perform, publicly display, or create derivative works from any part of the Services. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal, non-commercial enjoyment.
If you believe content on the Services infringes your copyright, send a notice under 17 U.S.C. § 512(c) to our designated agent at contact@mauricethemusic.com including the information required by the DMCA. We will respond in accordance with applicable law and may terminate accounts of repeat infringers.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONE CULTURE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR TRADE USAGE. We do not warrant that the Services will be uninterrupted, error-free, or that content will always be accurate or current.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONE CULTURE AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD $100. Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted.
You agree to indemnify and hold harmless One Culture LLC and its officers, members, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your User Content, your use of the Services, or your breach of these Terms.
You may stop using the Services and delete your account at any time. We may suspend or terminate your access to any part of the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or created risk for us or other users. Sections that by their nature should survive termination (including Sections 5, 8, 10, 11, 12, 14, and 15) will survive.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Wilmington, Delaware or, at your election, your county of residence. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
You and One Culture each waive the right to a jury trial and to participate in a class action or class-wide arbitration. Claims may be brought only on an individual basis.
Notwithstanding the above, either party may seek injunctive or equitable relief in court to protect its intellectual-property rights. You may opt out of arbitration by emailing contact@mauricethemusic.com within 30 days of first accepting these Terms, with your name and a statement that you decline arbitration.
This section applies if you access the Services through our iOS application obtained from the Apple App Store. These Terms are between you and One Culture LLC only, not with Apple Inc. ("Apple"). One Culture, not Apple, is solely responsible for the app and its content.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new effective date and, where appropriate, notify you by email or in the app. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
